Real estate brokers and agents facilitating transactions in RERA-registered projects are required to obtain registration under the Real Estate (Regulation and Development) Act, 2016. While the law is often associated with developers, it also places statutory obligations on intermediaries involved in property transactions.

Under the Act, any person who acts as an intermediary in the sale or purchase of a plot, apartment or building for commission or any other consideration is classified as a real estate agent. The definition covers brokers, property dealers, consultants and other intermediaries marketing or facilitating transactions.

Section 9 of the RERA Act makes registration with the respective State RERA Authority mandatory for agents dealing in registered projects. Conducting such transactions without valid registration amounts to a violation of the Act.

Registered agents are required to provide accurate information to buyers, disclose project approvals and other relevant documents, prominently display their RERA registration number and refrain from making false or misleading claims regarding projects.

The Act also prescribes penalties for non-compliance. Agents operating without registration may face penalties of up to ₹10,000 per day, subject to a maximum of 5 per cent of the cost of the property concerned. The Authority may also suspend or revoke registration in cases involving misleading information or other violations.

In Telangana, TG-RERA regulates the registration of real estate agents. According to official data, 5,167 agents are currently registered with the Authority. Homebuyers are advised to verify an agent's registration status through the official TG-RERA portal before entering into a property transaction.

By bringing brokers and agents within the regulatory framework, the RERA Act seeks to improve transparency, accountability and professionalism across the real estate sector while strengthening consumer protection.
