Developer cannot shift promised charges to buyer, says authority

MahaRERA has directed a developer to honour a commitment to bear stamp duty and registration charges after the developer later sought to shift the cost to the buyer. The dispute concerned a plotted project in Raigad near Mumbai. The buyer booked the property in March 2025 and paid about ₹1.66 crore, covering sale consideration, maintenance security deposit and corpus fund.

An allotment letter dated March 11, 2025 stated that the developer would bear stamp duty and registration charges. When the sale deed was subsequently to be registered, the developer asked the buyer to pay the charges, describing the earlier reference as a typing mistake. MahaRERA rejected that explanation. The authority noted that the developer's own Deviation Report, uploaded on January 7, 2025, also recorded that the developer would bear stamp duty and registration charges.

The case highlights the importance of reading allotment documents, agreements and disclosures together. Buyers should preserve original allotment letters, payment records and project disclosures when a commercial promise affects the final cost.
